As a parent of a child with a disability, planning your estate is vital to ensure the future needs of your child are met. Parents who have children with disabilities face many challenges planning their estate.
How do you leave funds for the benefit of the child without causing the child to lose important public benefits?
How do you ensure the funds are well managed?
What is fair in terms of distributing your estate between your disabled child and your other children?
How do you make sure there is enough money to meet your disabled child’s needs?
Public benefits programs alone are often an insufficient resource. At the same time, if a person with a disability has too many assets or too much income, he or she is not eligible to receive these public benefits. Someone who is eligible for Medicaid can become ineligible directly upon inheriting money, property, or other assets. Therefore, it is important to plan your estate in a way that will minimize the loss of public benefits.
