Effective TODAY (October 1, 2008) there are new numbers for the Standard Utility Allowance (SUA) and Private Pay Rates.
The Private Pay Rates are used to determine of the period of ineligibility on ALTCS cases when there has been a transfer or gift. The Private Pay Rates can also affect cases involving an Income-Only/Miller Trust. If income exceeds the private pay rate, the person cannot use an Income-Only/Miller trust to establish eligibility unless there is a specific finding of undue hardship.
The SUA affects the calculation of the CSMIA on a community spouse case, which can also affect the Share of Cost calculation.
Private Pay Rate: $5,808.25 for Maricopa, Pima and Pinal Counties; $5,158.40 for the rest of the state.
Standard Utility Allowance: increase from $314 to $326.
